Global Terms of Use

1. Acceptance of Terms

By accessing or using any website, platform, digital publication, media, or service operated by National Healing Arts Institute LLC (“NHAI,”"NAHAS" “we,” “our,” “us”), you agree to these Global Terms of Use. If you do not agree, you may not use our Services.

2. Definitions

Account – A user profile created to access NHAI Services. Subscription – Any paid membership granting access to premium content or resources. User Submissions – Feedback, comments, or other non‑uploaded content you provide. Content – Educational materials, media, documents, videos, and coursework provided by NHAI.

3. Jurisdiction

These Terms form an agreement between you and National Healing Arts Institute LLC, headquartered at 548 Market St #662113., San Francisco, CA 94104. You are responsible for complying with local laws when accessing our Services.

4. Eligibility

You must be at least 18 years old to use our Services. If you create an Account or Subscription on behalf of an organization, you confirm you are authorized to bind that organization to these Terms.

5. Personal Information & Privacy

Your use of NHAI Services is governed by our Privacy Policy. You agree to provide accurate information and maintain the confidentiality of your login credentials. Report unauthorized access immediately to legal@nhaiedu.org.

6. Intellectual Property

All trademarks, logos, course materials, publications, and digital assets are owned by NHAI or its licensors. You may not reproduce, distribute, or create derivative works without written permission.

7. License Grants

7.1 Use of Digital Platforms

We grant you a limited, non‑exclusive, non‑transferable license to use our digital platforms for personal, non‑commercial educational purposes.

7.2 Access to Educational Content

You may view, download, and print select materials for personal use unless otherwise restricted. Redistribution or publication requires written authorization.

8. Content Disclaimers

NHAI provides educational and informational content only. Our content is not medical, legal, or professional advice and should not replace licensed clinical care. We are not responsible for third‑party content or references.

9. Prohibited Conduct

You agree not to:

  • Use the Services for unlawful purposes

  • Impersonate others or misrepresent your identity

  • Upload harmful, defamatory, obscene, or infringing content

  • Attempt to bypass security features

  • Scrape, harvest, or extract content using automated tools

  • Use NHAI content to train or develop AI systems without permission

  • Harass or threaten other users or NHAI personnel

NHAI may determine violations at its discretion and take appropriate action.

10. Termination

We may suspend or terminate your Account or access at any time for violations of these Terms. You may cancel your Account or Subscription through your account settings or by contacting support@nhaiedu.org.

11. Proprietary Rights

NHAI retains ownership of all institutional materials and digital assets. By submitting User Submissions, you grant NHAI a perpetual, royalty‑free license to use and adapt those submissions for institutional purposes.

12. Indemnification

You agree to indemnify and hold harmless NHAI, its affiliates, employees, and partners from any claims arising from your misuse of the Services or violation of these Terms.

13. Disclaimers; No Warranties

NHAI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. No advice or information obtained through the Services creates any warranty not expressly stated.

14. Limitation of Liability

NHAI is not liable for indirect, incidental, consequential, punitive, or exemplary damages. Total liability will not exceed the amount paid by you in the three months preceding the claim or $100, whichever is greater.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of California.

15.2 Informal Resolution

Before arbitration or litigation, both parties agree to attempt informal resolution by sending written notice to:

15.3 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in San Francisco, California, unless otherwise agreed.

15.4 Class Action Waiver

All arbitration must occur on an individual basis. Class or collective actions are not permitted.

16. Miscellaneous

These Terms do not create a partnership or employment relationship. If any provision is unenforceable, the remaining provisions remain in effect. NHAI may assign its rights under these Terms; you may not.

17. Claims

Any claim arising from your use of the Services must be filed within one (1) year of the event giving rise to the claim.

18. Promotional Codes

Promotional offers or codes issued by NHAI are subject to separate terms.

19. Gift Subscriptions

Gift subscriptions, if offered, are governed by separate policies.

20. Changes to the Agreement

NHAI may update these Terms periodically. Material changes will be communicated as required by law. Continued use of the Services after changes constitutes acceptance.
